In these Terms, the following words have the meanings given:
By creating a CreatorSafe account, clicking “Create account”, or otherwise accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our Data Processing Agreement (Section 14), collectively forming the entire agreement between you and BZNlabs.
If you are entering into these Terms on behalf of a company or organisation, you represent that you have authority to bind that entity, and “you” refers to that entity.
If you do not agree to these Terms, you must not use the Service. Use of the Service by minors under 18 is not permitted. By registering, you confirm you are at least 18 years of age.
CreatorSafe provides Creators with: (a) a hosted fan capture page for collecting confirmed email opt-ins; (b) tools to broadcast emails to confirmed Fans; (c) drip email sequence automation; (d) fan list management, source tracking, and CSV export; and (e) optional custom domain routing on paid tiers.
CreatorSafe is an email list ownership and broadcast tool. It is not a platform for hosting, distributing, or monetising content of any kind. We do not store, transmit, or view any content produced by Creators on third-party platforms.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice, and to introduce new features at our discretion. Material changes to functionality affecting paid Subscribers will be communicated at least 30 days in advance.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] of any unauthorised access to your account.
You must provide accurate, complete, and current account information. You may not: (a) create an account on behalf of another person without their consent; (b) use a username that infringes any third-party trademark; or (c) maintain more than one active free account simultaneously.
BZNlabs may suspend or terminate accounts that are inactive for more than 12 consecutive months after providing 30 days written notice to the registered email address.
You agree to use CreatorSafe only for lawful purposes and in accordance with these Terms. You must not use the Service to:
Violation of this Section may result in immediate suspension or termination of your account without refund, and may be reported to relevant authorities where required by law.
You are solely responsible for ensuring all Broadcasts comply with applicable email marketing laws, including the EU ePrivacy Directive, the Irish Electronic Commerce Act 2000, the CAN-SPAM Act (if your audience includes US residents), CASL (if your audience includes Canadian residents), and any other jurisdiction-specific regulations applicable to your recipients.
By using the Service, you represent and warrant that: (a) every Fan on your list has provided explicit, informed consent to receive emails from you; (b) you will honour unsubscribe requests immediately and irrevocably; (c) your Broadcasts accurately identify you as the sender and include a valid postal or email address.
CreatorSafe automatically appends an unsubscribe link to all Broadcasts. You must not attempt to override, remove, or disable this mechanism.
We reserve the right to monitor aggregate email sending patterns (not Content) for abuse detection and deliverability protection. If your sending patterns trigger spam complaints at rates exceeding industry thresholds (typically above 0.1% complaint rate), we may pause your sending capability and contact you to resolve the issue.
You retain full ownership of all Content you create and send through the Service. By using the Service, you grant BZNlabs a limited, non-exclusive, royalty-free licence to store, process, and transmit your Content solely as necessary to provide the Service.
You represent and warrant that you own or have all necessary rights to the Content you submit, that it does not infringe any third-party intellectual property right, and that it complies with all applicable laws.
BZNlabs owns all intellectual property in the CreatorSafe platform, including but not limited to its software, design, trademarks, and documentation. These Terms grant you no right, title, or interest in CreatorSafe's intellectual property beyond the limited right to use the Service as described herein.
“CreatorSafe” and the CreatorSafe shield logo are trademarks of BZNlabs Limited. You may not use our trademarks without prior written consent except to factually refer to the service you use.
Paid Subscriptions are billed monthly in advance via Stripe. Prices are displayed in USD and exclusive of any applicable taxes (VAT, sales tax, etc.), which will be added where required by law.
Subscriptions automatically renew each month unless cancelled before the renewal date. You may cancel at any time via your account settings or by contacting us; cancellation takes effect at the end of the current billing period and no pro-rated refund is issued for unused time, except where required by applicable consumer protection law.
If a payment fails, we will notify you and attempt to recharge. If payment remains outstanding after 7 days, your account may be downgraded to the Free tier. Fan data is retained for 30 days following downgrade to allow you to export or restore service.
Right of withdrawal: Under EU consumer law, you have a 14-day right of withdrawal from the date of first purchase of a paid Subscription. However, by expressly requesting that the Service commences immediately upon purchase (which it does by default), you acknowledge that the right of withdrawal lapses upon commencement of service delivery, in accordance with Article 16(m) of the EU Consumer Rights Directive. If you do not wish to waive this right, please contact us before activating your paid Subscription.
We reserve the right to change pricing with 30 days written notice to existing Subscribers. Continued use of the Service after a price change constitutes acceptance of the new pricing.
We aim to provide a reliable service but we do not provide a guaranteed uptime SLA under these Terms. The Service is provided “as available” and may be subject to interruptions for maintenance, infrastructure issues, or events outside our reasonable control.
Email delivery is provided through third-party infrastructure (currently Resend). We do not guarantee that any Broadcast or confirmation email will be delivered successfully to any particular recipient. Delivery rates are affected by factors entirely outside our control, including recipient mail servers, spam filters, and ISP policies.
While we implement industry-standard backups and data protection measures, we do not guarantee that Fan Data stored on the Service will never be lost, corrupted, or inaccessible. You are solely responsible for maintaining your own copies of your Fan list. We strongly recommend regularly exporting your Fan list via the CSV export feature.
Scheduled maintenance will be communicated in advance where practicable. Emergency maintenance may occur without prior notice.
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.
BZNlabs does not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any Broadcast will reach its intended recipients; (d) using the Service will protect your business from platform bans, deplatforming events, or audience loss on third-party platforms; (e) any results obtained from the use of the Service will be accurate or reliable.
CreatorSafe is a tool for building and communicating with an email list. We make no representation that it will prevent, mitigate, or remedy any harm arising from actions taken by third-party platforms against Creator accounts on those platforms.
To the maximum extent permitted by applicable law, BZNlabs, its directors, officers, employees, agents, and licensors shall not be liable for any:
Aggregate liability cap: In all cases, BZNlabs's total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the total fees paid by you to BZNlabs in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) €100 (one hundred euros).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish or EU law.
You agree to defend, indemnify, and hold harmless BZNlabs, its directors, officers, employees, contractors, and agents from and against any claims, actions, suits, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
BZNlabs reserves the right to assume exclusive control of the defence of any matter subject to indemnification by you, at your expense.
You may terminate your account at any time by contacting us at [email protected] or using the account deletion feature. Termination takes effect within 48 hours of request. Upon termination, your access to the Service ceases and your Fan Data will be permanently deleted within 30 days, subject to any retention obligations imposed by law or our Privacy Policy.
BZNlabs may suspend or terminate your account immediately and without prior notice if: (a) you breach these Terms; (b) your Broadcasts generate spam complaint rates above acceptable thresholds; (c) we receive credible evidence of illegal activity connected to your account; (d) you fail to pay any outstanding fees after reasonable notice; or (e) we are required to do so by law or a court order.
Upon termination for cause, no refund will be issued for any prepaid Subscription fees.
Sections 7, 10, 11, 12, 14, 15, and 16 survive termination of these Terms.
This Section constitutes the Data Processing Agreement (“DPA”) between you and BZNlabs required under Article 28 of the EU General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679). By accepting these Terms, you also enter into this DPA.
With respect to Fan Data: you are the Data Controller and BZNlabs is the Data Processor. You determine the purposes and means of processing Fan Data; BZNlabs processes Fan Data only on your documented instructions as set out in these Terms and the Service documentation.
With respect to Creator account data (your own personal data): BZNlabs is the Data Controller. This is governed by our Privacy Policy.

Fan Data is stored in EU-located Cloudflare D1 instances (EU jurisdiction flag enabled). Where sub-processors transfer data outside the EEA (for example, Resend processing email delivery metadata), such transfers are governed by Standard Contractual Clauses (SCCs) in accordance with GDPR Chapter V. Details available on request.
BZNlabs Limited is subject to the jurisdiction of the Irish Data Protection Commission (DPC) as its lead supervisory authority under GDPR Art. 56. Fans and Creators may lodge a complaint with the DPC at dataprotection.ie.
The Service integrates with third-party services including Cloudflare (infrastructure), Resend (email delivery), and Stripe (payments). Your use of these services is subject to their respective terms and privacy policies. BZNlabs is not responsible for the availability, accuracy, or conduct of any third-party service.
CreatorSafe is designed for use in conjunction with third-party creator platforms (such as content subscription services, social media platforms, and video platforms). BZNlabs has no affiliation with, endorsement of, or responsibility for any such platform. You are solely responsible for ensuring that your use of CreatorSafe complies with the terms of service of any third-party platform on which you operate.
BZNlabs shall have no liability for any losses arising from enforcement action, account suspension, or deplatforming by any third-party platform, whether or not that action relates to your use of CreatorSafe.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
Both parties agree to submit to the exclusive jurisdiction of the courts of Ireland to resolve any legal matter arising from these Terms, except that BZNlabs may seek injunctive relief in any court of competent jurisdiction to prevent or stop infringement of its intellectual property rights.
For Creators who are consumers resident in the EU, nothing in these Terms affects your rights under applicable mandatory consumer protection legislation in your country of residence, and you may also bring proceedings in the courts of your country of residence.
The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. Our contact email for ODR purposes is [email protected]. We are not obliged to participate in alternative dispute resolution and do not commit to do so.
We may modify these Terms from time to time. If we make material changes, we will notify you by email to the address associated with your account at least 30 days before the changes take effect. Non-material changes (such as clarifications, corrections, or changes required by law) may take effect immediately upon posting.
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
Entire agreement: These Terms, together with the Privacy Policy and any order forms or Subscription confirmations, constitute the entire agreement between you and BZNlabs regarding the Service and supersede all prior agreements, representations, and understandings.
Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force.
No waiver: BZNlabs's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer any of your rights or obligations under these Terms without BZNlabs's prior written consent. BZNlabs may assign these Terms (including in connection with a merger, acquisition, or sale of assets) on reasonable notice to you.
Force majeure: Neither party shall be liable for any failure or delay in performance resulting from causes beyond their reasonable control, including acts of God, war, terrorism, governmental action, natural disaster, or internet infrastructure failure.
